
Protection of Children's Right to Education in Kerala
As per Section 31 of the RTE Act, 2009, the Kerala e Commission for Protection of Child Rights can monitor the implementation of the RTE Act, 2009 and Kerala RTE Rules, 2011, by inquiring into complaints relating to children's right to free and compulsory education. The Commission can make recommendations to the Government on initiation of appropriate proceedings, for award of interim compensation and also approach the Courts, if necessary. As per the KeSCPCR Rules 2012:
Complaints may be made to the Commission in Malayalam or in English
No fee shall be chargeable on such complaints
The complaint shall disclose a complete picture of the matter leading to the complaint including name and address of the respondent
The Commission may seek further information/affidavits as may be considered necessary and sworn ements of the complainant
While making a complaint, please ensure that the complaint is:
Clear and legible and not vague, anonymous or pseudonymous
Genuine, not trivial or frivolous
Not related to civil disputes such as property rights, contractual obligations & the like
Not related to service, labour or industrial dispute matters
Not pending before any other Commission duly constituted under law or sub-judice before a Court/Tribunal
Not already decided by the National or any other State Commission or Court
Not a mere copy of complaint addressed to some other authority
Not outside the purview of the Commission on any other grounds
